Extinguish or amend an existing Council easement

Council requires easements for several reasons, including to protect Council’s underground infrastructure and access.

You can apply to Council to remove or change an easement by submitting an 'Easement - Extinguish or amend existing Council easement' application through Council's Online Services. If you do not have an existing account, you will need to register.

Council will consider your application and whether the purpose of the easement is to be retained, or whether approval can be granted. If required, a new easement may need to be created over the land for public utility purposes. Council will also consider requests for amendments to existing Council easements for development applications.  

You may need to pay compensation, valuation and Titles Queensland registration fees if your application is approved.

If you wish to build within an existing easement, refer to Building over or adjacent to a stormwater or within a Council easement.

How to apply

Step 1.Collect the supporting documents

You will need to provide:

  • relevant design plans
  • a Council development application Decision Notice or information request
  • relevant authority correspondence/approvals, if applicable.

Step 2.Complete an online application 

  • Sign in to Council's Online Services (Instructions).
  • Go to ‘Enquiries’.
  • Search for ‘Corporate - Tenure Agreements’ and click ‘Start’ to begin the process.
  • Select the activity - ''Easement - Extinguish or amend existing Council easement’.
  • Complete the questions.
  • Read and accept Council’s terms and conditions.
  • Payment by MasterCard or Visa is required at the time of lodgement, per Council's fees and charges..
